Because we take every effort to accommodate a trial class, if a trial lesson is not cancelled within 24 hours, the next trial (if desired) will be paid at a class charge. Additionally, two cancelled trials and the trial is no longer free.

I further acknowledge and agree that there are certain inherent dangers in playing tennis and that Kids Golf and Tennis Inc. shall not be liable for any personal injuries, property damage, or other loss sustained by me or the named participant in, on or about the premises, or arising out of the use or intended use of any facilities, equipment or other property of Kids Golf and Tennis Inc. If I enroll, or enroll my child(ren), in programs and am asked to furnish Kids Golf and Tennis Inc. with appropriate medical exams, I agree to furnish such exams and records. If a child must drop out of Kids Golf and Tennis Inc. classes due to a medical concern or issue, we require a note from their physician. A credit will be offered for the remainder of the lessons. Classes can then be completed in the following session. If the child does not register for the entire following session, we cannot guarantee a consistent weekly class. I certify that my child has no known medical or other conditions that could interfere with his/her participation in Kids Golf and Tennis Inc. activities. I also understand and accept that the practice of tennis, both indoor and outdoor, involves certain risks of physical injury. Therefore, I, individually and on behalf of my child listed above, hereby release, discharge, and hold harmless Kids Golf and Tennis Inc. each of its respective parent, subsidiary, and affiliated companies, and each of their respective officers, directors, agents, representatives, employees, successors, assignees, and licensees (hereinafter, “the Released Parties”) from any and all claims, actions, damages, losses, liabilities, costs, and expenses of any kind whatsoever, including but not limited to any claims of negligence, arising out of, resulting from, by reason of, or in connection with my child’s participation in any Kids Golf and Tennis Inc. program or activity. I agree that I will not bring or be a party to any legal action or claim against the Released Parties, or any of them, based upon or arising out of my child’s participation in any Kids Golf and Tennis Inc. program or activity on any legal theory whatsoever (including without limitation personal injury, negligence, rights of privacy and publicity, or defamation). I understand and agree that Kids Golf and Tennis Inc. has the right to terminate the enrollment of any child from Kids Golf and Tennis Inc. if it, in its sole discretion, determines that the continued attendance of the child in the program is not in the best interest of the child or the program. I agree to supervise or designate a responsible adult to supervise my child prior to and immediately after his/her Kids Golf and Tennis Inc. activities. I understand and agree that in case of an allergic reaction, I am solely responsible for attending to and treating my child. Kids Golf and Tennis Inc. coaches are not authorized to administer medication or EpiPens. Kids Golf and Tennis Inc. and its agents reserve the right to take and utilize photographs, video, or any type of recording of participating children and their parents, caregivers, or anyone accompanying them to Kids Golf and Tennis Inc. while engaged in our classes or associated activities. I consent to Kids Golf and Tennis Inc. use of the photographs, videos, or recordings of my child, me, or the guardian I have designated for advertising, promotional, or related purposes, and waive all rights to compensation and other rights which may arise as a result (including any rights under N.Y. Civil Rights Law 50). I understand and agree that the email address(es) I have provided herein will be added to the distribution list for Kids Golf and Tennis Inc. and its affiliate programs. In addition, in case of accident or injury to me or my child(ren) and if an emergency contact person cannot be reached, I grant Kids Golf and Tennis Inc. permission to obtain medical attention if necessary, for which I will be financially responsible. Kids Golf and Tennis Inc. reserves the right to close court or facility for repair or alterations. Kids Golf and Tennis Inc. reserves the right to cancel this contract at any time, at its sole discretion, and management's sole liability shall be to credit any amounts previously paid on a pro-rate basis. I understand that make-up lessons will always be applied if Kids Golf and Tennis Inc. cancels the class session, however, if the class is held and I or my children do not attend for personal reasons, there will be a limit of 1 (one) class eligible for makeup. Kids Golf and Tennis Inc. does not offer refunds. If a child chooses to leave prior to the 2nd class of the session, they get a credit for the remainder. If a child is removed and has a physician note, they get credit for the remainder of the session. If a child must drop out of Kids Golf and Tennis Inc. classes due to a medical concern or issue, we require a note from their physician. Students will then be given a credit for the remaining classes. Classes can then be completed in the following session. If the child does not register for the entire following session, we cannot guarantee a weekly time spot. Kids Golf and Tennis Inc. retains the right to any photographs or video taken at the facility to be used for publicity or advertising. Because children learn at different rates according to changes in their physical growth, social awareness, and cognitive understandings, Kids Golf and Tennis Inc. reserves the right to occasionally move individual children to a different group than they were initially registered for to increase the child's success and learning. Kids Golf and Tennis Inc. has the right to cancel a class at our discretion due to insufficient enrollment. Kids Golf and Tennis Inc. reserves the right to remove a child from a class permanently at their discretion and in that case, the removed child’s registration will be prorated and refunded to the payment method the registration was originally paid.
